Official Contest Rules is a web site owned by "We Are Community Foundation", a California non-profit organization (hereinafter referred to as the "Sponsor"). The person entering this contest is referred to as the "Contestant." Collectively, the Sponsor and the Contestant will be referred to as the Parties. By entering the Dream Home Contest (hereinafter referred to as the Contest), Contestant agrees to be bound by these Official Rules and the web site's Terms & Conditions, which shall constitute a contract between Contestant and Sponsor. All decisions of Sponsor with respect to the Contest shall be final.

Void where prohibited by law or regulation, the Contests shall be developed and administered through its Contest website ( Contestants may enter one or all of the active Contests and compete with other contestants for prizes. Each Contest will offer a real-property home (hereinafter referred to as the "Property") as the contest grand prize, subject to the rules set forth herein.

The following rules (the "Official Rules") govern the contest(s):

Contest Period

The Contest Period is the eligible time where Sponsor will accept entries from the Contestant. Once a Contest is listed and identified on the Contest website at, the contest is then officially active and available for Contestants to participate. The ending date for each Contest shall be listed in section "Contest Details" on the website. Each Contest shall continue to 11:59 P.M. Pacific Time on a designated Contest Ending Date. The Contest Period can be adjusted by Sponsor as necessary in accordance with these Contest Period rules. All entries submitted via mail to each Contest must be postmarked no later than Midnight Pacific Time, on the Ending Date of the Contest to be eligible to participate or win any of the designated Contest prizes.

Each Contest requires a minimum number of contestant entries to conduct the contest. In the event the minimum number of contestant entries for a Contest is not received during a designated Contest Period, that Contest Period may be extended as deemed necessary by Sponsor. Each Contest Period may be extended for up to ninety (90) days at the sole discretion of Sponsor. In the event the minimum number of Contestant entries required is still not achieved, Contestants have the option of applying their entry to another Contest or receive a full refund of their paid entry fee.

There is a designated limit to the number of entries that will be accepted for each designated Contest. Once the entry limit is achieved, the Contest shall be closed and no further entries will be accepted for that Contest. This, in effect, may shorten the designated Contest Ending Date, if the maximum number of contest entries is received prior to the Contest Ending Date.

Once the minimum number of contestant entries is received in accordance with the Contest rules, Sponsor shall select the prize winners and award the prizes. Sponsor shall announce the Contest winners within 5 days of the Contest Ending Date.

Grand Prize Valuation

Each Contest grand prize valuation (real property home) shall be a sum determined by an independent licensed real estate appraiser selected by Sponsor. The Contest valuation price of the Property shall be the amount determined by appraisal as its current fair market value at the time of the Contest Ending Date. The funds raised for the Contest shall not be less than the fair market value of the Property designated as the Grand Prize for that Contest as determined by the appraisal. The Grand Prize winner acknowledges that government authorities may place a different value on the home than the Sponsor placed on the home in determining any income, property, transfer, or other taxes or fees that may be attributable to the Grand Prize. There is no representation or warranty by Sponsor, actual or implied, that the Property could be sold for the Contest valuation price on the open market, or at any other price.


Contestant must be at least 18 years old as of the date of Contest entry to be eligible to win. Contestant must also submit the contest entry within the designated Contest entry period, have paid the requisite entry fee, and comply with all the Official Rules as defined herein. Subject to the Contest entry criteria, the Contest is open to anyone, including and not limited to non-profit organizations, business entities, or investors. Employees, officers, directors, and affiliates of Sponsor, as well as their immediate family members and the residents of their households, are not eligible to participate in any Contest.

Sponsor has endeavored to comply with all legal requirements in developing the Dream Home Contest and will not knowingly accept entries from residents of jurisdictions where the Contest does not comply with the laws of the jurisdiction in which the individual resides. If any governmental entity determines that a contestant violates applicable laws or regulations, the Sponsor shall have the right, in its sole discretion, to disqualify a contestant from the Contest and return any associated entry fee. Sponsor makes no representation regarding the access of the materials on this Site from jurisdictions where its contents or the Contest is illegal or prohibited. Those individuals who choose to access this Site and participate in the Contest from those jurisdictions do so at their own risk and are responsible for compliance with all local laws and regulations.

Subject to its sole discretion, Sponsor reserves the right to disqualify any contestant that has: (1) violated the Official Rules; (2) interfered with the Contest; (3) attempted to manipulate the Contest results; (4) submitted material that is either illegal, harmful, threatening, abusive, harassing, defamatory, obscene, pornographic, offensive, or violates any rights of third parties, including and not limited to intellectual property rights, right of privacy, or right of publicity; or (5) provided false information to Sponsor. Each entry will be evaluated solely upon the merit of its contents and Sponsor will not discriminate in any manner, including on the basis of race, color, national, or ethnic origin. Sponsor also reserves the right to suspend the contest in the event of unforeseen circumstances beyond the Sponsor’s control such as catastrophic occurrences, acts of God, or civil disturbance that render it impractical or impossible to complete or fulfill the sweepstakes.

Except where prohibited by law, the winner must agree to and execute the following affidavits to be eligible to claim the prize: (1) Affidavit of Eligibility; (2) a Liability Release; and (3) a Publicity Release. The documents ensure the winner’s eligibility and compliance with all the rules, terms and conditions for the Contest, release Sponsor from liability related to or arising from the Contest, and authorize Sponsor to use the winner’s name, image, likeness, voice, and biographical information for publicity purposes. Winner will also be required to provide any other information needed by Sponsor to comply with applicable laws and regulations, including those relating to the proper titling of the home and payment of income taxes.

How to Enter

Eligible individuals may enter the Contest by accessing the contest website at Contestants may select and participate in the Contest of their choice by making a minimum donation of $25.00 to We Are Communities Foundation and submitting their entry in compliance with all the Contest rules and requirements. A contestant is allowed to participate in one or more Contests and may enter as many times as he or she desires subject to each entry satisfying the Contest entry requirements. All contest entry fees are non-refundable, except under the circumstances as noted herein.

To qualify for entry into the Contest, all entries must include the following:

1. The contestant has completed all information and answered all questions listed on the contest application available on the web site. Video submissions are accepted in lieu of written submissions, but video submissions must still include all content requested.

2. The contestant has submitted the minimum donation for the specified Contest. Only credit card payments are accepted for donations.

All Contest entry fees will be held until the Contest is closed and the prize property has been awarded to the winning contestant.

Entry Review and Judging

Each Contest is designed and intended to be a rewarding and positive opportunity for both the contestant and the community. This is not a contest of chance but rather one of skill as it is based on the content of the entry rather than the number of entries. To be eligible to win a prize, each contestant must answer all the questions listed on the contestant entry form and pay the required entry fee. The story told in the entry submission can be personal to the Contestant or can be about someone else the Contestant has knowledge of.

Once the number of entries needed for a contest is received, the Contest will close and the submitted entries will be given to a panel of judges for evaluation. Based upon the information provided, the judges will score each contestant entry on a scale of 1 to 100, with 100 being the highest score. Contestants will also be given the opportunity to have their friends and family vote for their entry. Votes from Contestants fans will constitute 10% of the weighted average score. The contestant with the highest average score will be the winner. In the case of a tie, the judges will re-evaluate the tied entries to make a final determination of the winner. Where contests have multiple secondary prizes, the prizes will be awarded to contestants with the next highest ranking score.

The evaluation criteria of the entries are based on the quality and the compelling nature of the story coupled with sincere and honest responses to the questions. We believe that effective writing skills are important factors for telling the persuasive story for a winning entry. However, if Contestants feel that their writing skills would not be as effective to tell their story, then Contestants have the option of video recording their story. Contestants can use family and friends as necessary to properly depict their story. The length of any video submission is limited to no more than 10 minutes. Videos can be submitted via the web site or by mailing a recorded DVD to our office.

An individual who enters the Contest(s) multiple times must make a separate minimum donation for each attempt and complete all entry requirements separately for each entry.

Successful Entry

Winners for a designated Contest will be determined based on the compelling nature of their story and their sincere and honest responses to the questions. Regardless whether the entry is written or in video form, the evaluation criterion remains the same. As in the written entries, the judges will score the video based on the contents of the message contained within the video. Either format has an equal chance of winning. Since this is a contest of skill and not of chance, there are no "odds" of a particular contestant being the final winner. Each entry will be ranked based on their score. Prizes will be distributed based on the entry’s ranking. The entry ranked number one, will receive the grand prize home. The remaining entries will receive the remaining prizes. All contestants will receive a prize.

The Grand Contest prize will be awarded from the total number of contestant entries received for that Contest. Since, there are only a limited number of entries that will be accepted for each contest, the odds of winning the grand prize are one (1) out of all entries received for that contest.

Publicity Release

All winners of a Contest are subject to executing a Publicity Release to allow Sponsor to publically announce, through all forms of media, including local and national newspapers, press releases, television, radio, and web media sites, the winner of the Contest. Winners of prizes agree to participate in interviews with Sponsor or Sponsors assigned publicist. By accepting a prize, winner grants Sponsor permission for the use of his/her name, likeness, and biographical information for advertising and promotional purposes without additional compensation, except where prohibited by law. Contestant winners subsequently consent to the rights to use, distribute, and rebroadcast recorded interviews and press through media sources selected by Sponsor.


Every Contestant will receive a prize, but there will be only one (1) grand prize winner chosen for each separate Contest issued as designated on the Contest website at Before entering any Contest, Contestants should carefully review these official rules and the specific terms of each contest. Provided that all Contest requirements have been met, the grand prize winner of each Contest will be awarded a fee-simple title to the real property identified for that Contest as designated on the Contest website or the equivalent cash value of the home, as requested by the grand prize winner. The Sponsor, at their sole discretion can substitute any grand prize home with another home in the same locale of equal or greater value. Contestants can elect to accept the alternate cash prize, if applicable, for the particular Contest.

In the event Sponsor has not received the minimum required number of entries, the contest can be extended for up to ninety (90) days. The minimum required number of tickets is determined at 5:00 p.m., Pacific Standard Time, based on the date selected for closing of the Contest. If fewer than the minimum numbers of tickets are sold by 5:00 p.m., Pacific Standard Time, on the Closing Date of the contest, the Contestant will have the option of applying his entry to another Contest or receiving a full refund of their entry fee.

When real property is awarded as the Contest prize, it will be granted as Fee-Simple Title to the property, free from any mortgage with property taxes prorated and paid up-to-date at time of closing. The property will be transferred to the contest winner along with a title insurance commitment, the cost of which shall be paid by the Sponsor. Additional closing costs to be paid by Sponsor shall be limited to attorney, title company services, and related mailing fees for signatures related to the legal transfer of the property. The winner is not obligated to attend a closing for the property. However, if said winner chooses to attend the closing, the winner will be responsible for all of their own personal costs and expenses associated with their attendance at the closing of the property, including but not limited to their own transportation to and from the closing, hotel, meals, etc. Furthermore, the Contestant is responsible for the payment of all property taxes assessed on the awarded property after the time of closing.

The escrow and title company used to facilitate the closing process of the property will be chosen by the Sponsor. Sponsor intends to complete the transfer of title and ownership of the residence on or before two (2) months following the end of the Contest Period. The exact closing date shall be set by the title company. Real property awarded as a Contest prize shall be awarded "AS IS" and "WITHOUT WARRANTY OF ANY KIND BY SPONSOR OR ANY OTHER PERSON", expressed or implied, (including, and without limitation, any implied warranty of merchantability or fitness for a particular purpose).

Winning of tangible prizes in a contest in the United States are subject to gift taxes. Prize winnings are not taxable in some states, but are subject to federal tax from the Internal Revenue Service. The Sponsor is required to report the winning of prizes to the Internal Revenue Service. The sponsor will pay up to 25% of the federal assessed gift tax for any real property won and received by the Contestant. The Sponsor does not pay nor is obligated to pay the gift taxes assessed for alternative prizes (for example, if Contestant elects to receive the alternative cash prize instead of the grand prize home) awarded.

Sponsor has made every effort to display the Property as accurately as possible but cannot guaranty that there will not be any variations in color, display and appearance due to differences in the equipment used to capture and display the Property. Sponsor is not responsible for any variations in the representation, or display of the Property. The Property can be substituted at any time based on the Property’s availability. In the event of substitution, it will be a property located in the same local area to the displayed property. The substituted property will be of equal or greater value with similar size and specifications.

The winner will be notified using the contact information provided by the Contestant within five (5) days of the prize being awarded. If Sponsor is unable to confirm the winner with the contact information provided by Contestant within seven (7) days of notification being sent, or if a winner is disqualified, then the prize will be forfeited and awarded to an alternate Winner determined by Sponsor in its sole discretion. Sponsor is not responsible for misdirected mail or inaccuracies in the contact information provided by the Contestant.

Limitations of Liability

Each person who enters the Contest: (a) agrees that the Sponsor, its directors, officers, employees, agents, representatives, the home seller and all other prize providers are not responsible for any injuries, losses or damages of any kind arising in connection with, or as a result of, this raffle and/or that person’s failure to win or redeem any prize, or that person’s award of, acceptance of, or use of, any prize; and (b) releases and agrees to indemnify, defend, protect, and hold harmless the Sponsor, the home seller and all other prize providers and each of its respective officers, directors, shareholders, employees, agents, contractors, insurers, attorneys and affiliated entities from and against all losses, damages, rights, claims and actions of any kind arising in connection with, or as a result of, this Contest and/or that person’s failure to win or redeem any prize, or that person's award of, acceptance of, or use of, any prize; and (c) represents and warrants to the Sponsor that he/she has read and understands these Rules and agrees to be bound by these Rules and the Sponsor’s decisions, which will be final.

In no event will Sponsor, its employees, officers, directors, employees, representatives, agents, judges of the Contest, internet service provider, website provider be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential, statutory or punitive damages. Except prohibited by law, with respect to the Contest and to the prize(s), Sponsor makes no warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or habitability. Contestants should check their local laws regarding restrictions on disclaimer of warranties.

Contestant acknowledges and agrees that their name and the city and state where Contestant resides are non-confidential for all purposes and the Sponsor may disclose this information in conjunction with promotion of the Contest, its Sponsor, and related to prize winners and contests. Dispute Resolution

By entering the Contest, Contestant agrees that any dispute arising out of or relating to the Contest shall be resolved by binding arbitration before a single arbitrator administered by the American Arbitrations Association under its Residential arbitration rules. Contestant further agrees that any judgment rendered by the arbitrator may be entered in any court having jurisdiction thereof. The venue of the arbitration shall be in Los Angeles County, California USA, and shall not be subject to transfer to another venue or locale for any reason.

Contestant further agrees that any litigation related to or arising out of the Contest shall be brought only in the Superior Court of California, County of Los Angeles, or United States District Court, Central District of California. You have irrevocably and unconditionally consented to the jurisdiction of any such court and hereby irrevocably and unconditionally waive any defense of an inconvenient forum to the maintenance of any action or proceeding in any such court, any objection to venue with respect to any such action or proceeding, and to any right of jurisdiction on account of the place of residence or domicile of any party thereto.

Each entrant further agrees that the contestant will not commence or participate in any litigation or proceeding, either as a class representative or as a class member, and that contestant will never seek to obtain from Sponsor awards for, and he hereby waives all rights to claim, statutory, punitive, incidental, or consequential damages, or any other damages, including attorney’s fees, other than actual out-of-pocket expenses (i.e. costs associated with entering the Contest).

Governing Law

Sponsor is a Nevada corporation with foreign corporate status in the state of California. Since the Site can be accessed from all 50 states, as well as from other countries around the world, each of these jurisdictions has laws and regulations that may differ from those of the United States, by accessing this Site, both you and the Sponsor agree that the statutes and laws of the United States without regard to conflicts of laws principles thereof, will apply to the Contest, these Official Rules, the entire relationship between Sponsor and Contestants, and any legal proceeding arising there from (whether grounded in tort, contract, law or equity).

Amendment of Rules

In its sole discretion, Sponsor may amend the Official Rules from time to time. Amendments to the rules, which will be effective on the date posted, will be accessible on the Sponsor Website at


If any portion of the rules herein be deemed invalid for any reason, including conflicts with local laws or regulations governing administration of contests, such invalidity shall have no effect upon the remaining portions of the Contest Rules.

Entire Agreement

Both the Official Rules and the website Terms and Conditions ( are integral parts of the agreement between Sponsor and Contestants. Except to the extent reference is made thereto in these rules, there are no other representations, warranties, promises, agreements or understandings, oral, written or implied, among the Parties.
